1. Business identity

AvantPhoto is the trading brand and website of Philip Burrowes, Entrepreneur Individuel, registered under the commercial name Avant Photographique.

Legal name: Philip Burrowes EI
Commercial name: Avant Photographique
Public brand: AvantPhoto
SIRET: 988 958 724 00011
Address: 4 Moulin de Rome, 19470 Le Lonzac, France

TVA non applicable, article 293 B du CGI.

In these Terms & Conditions, “AvantPhoto”, “the Photographer”, “I”, “me” and “my” refer to Philip Burrowes EI. “The Client”, “you” and “your” refer to the person or organisation commissioning the services.

2. Application of these terms

These terms apply to photography, content creation, tuition and related services supplied by AvantPhoto to private individuals, businesses and organisations.

A booking is confirmed when the Client accepts the quotation or booking confirmation and pays any amount required to secure the booking. The quotation, booking confirmation and any separately agreed written terms form part of the agreement.

If a quotation or written agreement contains terms specific to a commission, those specific terms take priority where they differ from this page.

3. Quotations and prices

The price and scope of the commission will be confirmed before booking. Unless stated otherwise, quotations remain valid for 30 days.

Reasonable additional expenses, including travel, accommodation, parking, permits, couriers, specialist equipment and other agreed production costs, may be charged where identified in the quotation or approved by the Client.

Any material change to the agreed scope may require a revised quotation. AvantPhoto will obtain the Client’s agreement before carrying out chargeable work outside the agreed scope, except where urgent and reasonable expenditure is necessary to protect the commission or people involved.

4. Payment

Payment may be made by bank transfer or debit or credit card. Cheques are not accepted.

Bookings with a total value below €500 are normally payable in full when booked. For larger commissions, the quotation or invoice will state the booking payment, staged payments and final balance.

Unless otherwise agreed in writing, all outstanding sums must be paid before the final photographs or other finished materials are delivered.

Business invoices are payable by the due date shown on the invoice. Where French business-to-business late-payment rules apply, overdue amounts may attract statutory late-payment interest and the applicable fixed recovery charge. Different mandatory rules may apply to invoices governed by another jurisdiction.

Consumer clients will not be charged business late-payment penalties. AvantPhoto may withhold delivery or suspend further work while an agreed payment remains overdue.

5. Cancellation and rescheduling

The Client may request cancellation or rescheduling by contacting AvantPhoto in writing.

If the Client cancels more than 14 days before the scheduled commission, sums paid will normally be refunded, less any non-refundable costs already incurred with the Client’s agreement.

If the Client cancels within 14 days of the scheduled commission, AvantPhoto may retain amounts already paid to cover work completed, time reserved, reasonable losses and non-refundable costs. Any charge will be proportionate to the actual circumstances and will not exceed the agreed contract price.

AvantPhoto will make reasonable efforts to accommodate one request to reschedule. Rescheduling is subject to availability and may require payment of additional costs already incurred or caused by the change.

Wedding photography, multi-day productions, commissioned travel and other substantial bookings may have specific cancellation terms stated in the quotation or booking agreement.

If AvantPhoto must cancel and cannot provide a reasonable alternative date, all sums paid for services not supplied will be refunded within 14 days. AvantPhoto is not responsible for unrelated or consequential costs unless liability cannot legally be excluded.

6. The photography service

The Client must provide accurate information about the commission, locations, timings, subjects and required uses. Any essential photographs, people, products, compositions or deadlines must be identified before the shoot.

AvantPhoto will use professional judgement when selecting equipment and deciding creative matters including composition, lighting, timing, editing and photographic style.

No specific number of photographs is guaranteed unless stated in the quotation. AvantPhoto will select and deliver the photographs considered suitable and consistent with the agreed commission. Rejected, duplicate, test and technically unsuccessful frames are not part of the deliverable.

Finished photographs are normally supplied as edited JPEG files. RAW files, unedited files and working files are not included unless expressly agreed in writing.

Delivery dates are estimates unless a fixed deadline has been expressly agreed. AvantPhoto will notify the Client if an unexpected delay occurs.

7. Client responsibilities

The Client is responsible for obtaining access to locations and any permissions, permits or releases that the Client has agreed to arrange.

For commercial commissions, the Client is responsible for ensuring that its instructions, supplied materials, products, claims and intended uses are lawful and do not infringe another person’s rights.

The Client must identify any confidential information, restricted locations, safeguarding requirements or people who must not be photographed or shown publicly before the relevant photography takes place.

AvantPhoto is not responsible for missed photographs caused by lateness, absence, inaccurate instructions, access restrictions, weather, interference by third parties or circumstances outside reasonable control.

8. Review and corrections

The Client should report any material technical problem, missing agreed deliverable or other significant discrepancy within seven days of delivery.

Where reasonably possible, AvantPhoto will correct a genuine error or omission relating to the agreed service. Differences of personal taste do not constitute a defect where the work is consistent with the portfolio, briefing and agreed photographic style.

Additional editing, alternative treatments or changes outside the original brief may be quoted separately.

9. Copyright and licences

Copyright and all other intellectual-property rights in the photographs remain with Philip Burrowes unless a written agreement expressly transfers particular rights.

Payment for photography does not automatically transfer copyright. The Client receives a licence to use the delivered photographs for the purposes agreed in the quotation, booking confirmation or licence.

Commercial clients

The commercial licence will be defined by the agreed commission and may specify permitted media, territory, duration, campaign, organisation or project. Unless otherwise stated, a licence is limited to the commissioning Client and the agreed project.

The Client may provide files to designers, printers, publishers, agencies and other suppliers solely to produce authorised work for the Client. This does not give those suppliers an independent right to use, sell or license the photographs.

Private clients

Private clients receive a personal-use licence to download, store, display and make reasonable personal prints of their delivered photographs. The photographs may also be shared on personal social-media accounts unless otherwise agreed.

Personal-use photographs may not be sold, used to advertise a business, entered into commercial promotions or supplied for publication without written permission.

Restrictions applying to all clients

  • Photographs must not be used unlawfully, deceptively, or in material that is defamatory, pornographic or seriously prejudicial to the people depicted.
  • Photographs must not be sold, relicensed or supplied to an image library without written permission.
  • Copyright notices, metadata and credits must not be deliberately removed where they form part of the supplied file or publication agreement.
  • Material alteration, synthetic manipulation or use in artificial-intelligence training systems requires prior written permission.

Any right to be identified as the photographer, and any other applicable moral rights, are retained except where expressly waived or modified in writing to the extent legally permitted.

10. Portfolio and promotional use

For commercial and editorial commissions, AvantPhoto may use selected photographs to demonstrate and promote its work unless confidentiality, an embargo or another restriction has been agreed in writing.

Photographs of identifiable private clients, children, families, wedding clients or private events will only be used for AvantPhoto’s portfolio or promotion where appropriate permission has been obtained.

11. Image retention and file storage

The Client is responsible for downloading, checking and safely backing up delivered files.

AvantPhoto takes reasonable care when storing working and delivered files but does not guarantee permanent archival storage. Replacement files can only be supplied if they remain available and may incur a reasonable administration charge.

12. Insurance, responsibility and liability

AvantPhoto maintains professional insurance appropriate to its photography activities, including public-liability cover with a limit of indemnity of €5 million.

AvantPhoto will exercise reasonable professional care when creating, processing and delivering files but cannot guarantee that all digital files will remain compatible with every device, system or future technology.

Nothing in these terms excludes or restricts liability where exclusion is prohibited by law, including liability for death or personal injury caused by negligence, fraud, or deliberate misconduct.

Subject to those mandatory rights, AvantPhoto will not be responsible for indirect or consequential loss that was not reasonably foreseeable when the agreement was made.

For business clients, AvantPhoto’s total liability arising from a commission will not normally exceed the total amount paid or payable for that commission, except where such a limitation is prohibited by law.

13. Force majeure

Neither party will be responsible for delay or failure caused by circumstances beyond reasonable control. These may include severe weather, illness or injury, transport disruption, fire, flood, power or communications failure, industrial action, civil emergency, governmental restrictions or failure by an essential third-party service.

The affected party must notify the other as soon as reasonably possible. The parties will first try to reschedule, modify or complete the commission. If that is not reasonably possible, payment will be adjusted fairly to reflect work completed and unavoidable costs already incurred.

14. Ending the agreement

Either party may end the agreement if the other commits a serious breach and, where the breach can be corrected, fails to correct it within a reasonable period after receiving written notice.

AvantPhoto may suspend or end the service if the Client behaves unlawfully, abusively or dangerously; fails to provide necessary access or cooperation; or fails to make an agreed payment.

Ending the agreement does not affect rights, payments, licences or obligations that arose before termination.

15. Consumer rights

Consumers retain all mandatory rights and protections provided by the law applicable where the services are supplied, normally France or the United Kingdom. Nothing in these terms limits or excludes those statutory rights.

If you are dissatisfied with a service, contact AvantPhoto first at phil@avant.photo, explaining the problem and the resolution you are seeking. AvantPhoto will respond within a reasonable period and attempt to resolve the matter directly.

16. Governing law

Unless mandatory consumer law requires otherwise, agreements with AvantPhoto are governed by French law and disputes are subject to the jurisdiction of the competent French courts.

Where services are supplied in another country, including the United Kingdom, any mandatory local consumer protections continue to apply.
